Both GDPR and the LOPD-gdd establish that international data transfers can be made if the processor can ensure that the level of data protection is guaranteed through:

Adequate guarantees for data protection. (Art. 46 GDPR)
Carrying out an international data transfer without meeting the requirements in 83.5.c GDPR, would imply an infraction. In the event of this being a company, it could be penalised with an administrative fine (financial) for company responsible, or the private sector processor, of 20 million euros (€ 20,000,000) or an equivalent amount up to a maximum of 4% of the total global annual turnover of the previous fiscal year, whichever is the greater amount.
As per the current regulations for data protection (GDPR/LOPD-gdd), any person has the right to obtain confirmation about whether or not personal data relating to them is being processed. Furthermore, under the conditions prescribed by law, the interested persons have the right to access their data, as well as to request the rectification of incorrect data or, when applicable, to request its deletion when, among other reasons, the data is no longer necessary for the purposes it was originally gathered. In the case of cookies, these rights can be exercised subject to the limitations derived from the nature of these files.
In the conditions prescribed in the General Data Protection Regulation, as well as in the LOPD-gdd, the interested parties can request to limit the processing of their data, or its portability, in which case we will only keep it to exercise or defend claims.
