• An adequacy decision made by the EU commission (Art. 45 GDPR)
• Adequate guarantees for data protection. (Art. 46 GDPR)
• Binding Corporate Rules (Art. 47 GDPR).

Carrying out an international data transfer without meeting the requirements in 83.5.c GDPR, would imply an infraction. In the event of this being a company, it could be penalised with an administrative fine (financial) for company responsible, or the private sector processor, of 20 million euros (€ 20,000,000) or an equivalent amount up to a maximum of 4% of the total global annual turnover of the previous fiscal year, whichever is the greater amount.
